Welcome to Cricfit. Before you begin using our services, please read the following terms and conditions carefully. This agreement comes into force upon creation of your Cricfit app account and continues in force unless terminated by either party in accordance with the terms of this agreement.

Purpose and scope

This document sets forth the terms governing the use of our services, including user and Client responsibilities, payment terms, and limitations of liability.

Acceptance of terms

By accessing and using Cricfit’s services, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use our services.

Description of services

Cricfit provides online strength & conditioning programmes through the Cricfit app. Athletes will access training videos, direct coach support and a structured strength & conditioning programme.

Registration and user accounts

To access certain features or services, you may be required to create an account and provide personal information, such as your name, email address, and a password.

Content ownership and licences

You retain all rights to the content you provide to us. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display the content as necessary to provide the Services.

Unless otherwise stated and with exception to the below ‘Third party content’ clause, Cricfit and/or its licensors own the intellectual property rights for all material on cricfit.co.uk and the Cricfit app. All intellectual property rights are reserved. You must not:

• Republish material from cricfit.co.uk or the Cricfit App
• Sell, rent or sub-license material from cricfit.co.uk or the Cricfit App
• Reproduce, duplicate or copy material from cricfit.co.uk or the Cricfit App
• Redistribute content from cricfit.co.uk or the Cricfit App
• Create iframes around our site pages that alter in any way the visual presentation or appearance of cricfit.co.uk or the Cricfit App

Third party content 

Cricfit’s website and/or Services may contain content uploaded, posted, linked to or otherwise provided by third parties ("Third Party Content"). Such Third Party Content does not necessarily represent the views or opinions of Cricfit, nor does it imply endorsement by Cricfit.

Cricfit does not review, approve, or endorse any Third Party Content and is not responsible or liable for any content, advertising, products, services or information on or available from third party websites or material, including without limitation any liability arising from any offensive, defamatory, or unlawful content submitted by third parties.

Any reliance on or use of Third Party Content obtained through the Website is done at the user's own risk.

Cricfit will make efforts to promptly remove or disable access to any Third Party Content in response to valid legal requests or complaints, where it is found to be in violation of this Agreement, applicable laws, or regulations.

Payment terms

Payments for the Services must be made in accordance with the agreed-upon fees and payment schedule. Late payments may result in suspension or termination of the Services.

Restrictions on use

You agree not to use the Services for any unlawful purpose, to infringe upon the rights of others, or to interfere with the proper functioning of the Services.

Limitation of liability

Cricfit shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to the use of the Services.

Indemnification

You agree to indemnify, defend, and hold harmless Cricfit and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or related to your use of the Services.

Termination

Cancellations will take effect at the end of the current billing cycle, and no refunds will be issued for any remaining days. Your account will be deactivated at the end of the current billing cycle

Refund Policy

You are entitled to a refund within 14 days of purchase. Refunds will be evaluated on a case-by-case basis.

Safeguarding Measures

We are committed to the safety and security of all our users.

Parental Involvement

All accounts for users under the age of 18 must be registered and held by a parent or legal guardian. It is at the discretion of the parent or guardian to allow the child access to the app on their own device. The parent or guardian assumes full responsibility for monitoring the minor’s use of the app.

Use of Communication Features

The app includes functionality that allows users to send messages, images, and videos to coaches for the purpose of receiving coaching guidance. This feature is to be used strictly for coaching and training purposes. If this functionality is abused, the offending account will be subject to immediate deactivation. Any submission of inappropriate content will result in the registered account’s email being notified of the misuse. It is the responsibility of the account holder to ensure that all communications are appropriate and strictly related to coaching activities. Misuse of communication features may lead to permanent suspension and notification to relevant authorities if necessary.

Reporting and Monitoring

We encourage all users and guardians to report any suspicious or inappropriate activities within the app. Cricfit is committed to maintaining a safe environment and will investigate all reports promptly and thoroughly.

Use of Group Chat Features

The app includes group chat functionality intended for motivational purposes and for users to ask constructive questions relevant to their training. All communications within the group chat must be supportive, kind, and directly related to coaching and training. Users are expected to maintain a respectful and positive environment in all group interactions. Any messages that do not adhere to these guidelines will be subject to review, and actions may include warnings or account suspension for repeated or severe violations. We monitor group chats to ensure a safe and encouraging environment. Misconduct or misuse of the group chat feature can lead to suspension of chat privileges and, in cases of severe violations, permanent account deactivation.

Health & Safety

In the event of an injury during a training session, please cease all activity and consult a healthcare provider. You understand that any form of exercise comes with an inherent risk. You will take time to watch the instructional videos and complete all the warm ups before each session to reduce this risk. You understand the importance of checking if your surroundings are clear and to keep any distractions, such as pets, away during the session.

If you are not sure about any exercise, you will ask for help before continuing. You acknowledge that the coaching on the app is a means of general guidance and motivation. It is your responsibility to be aware of your capabilities and do what you are comfortable with. Medical advice should be sought if there is any doubt. You will remain hydrated during all sessions and understand the purpose of the coaching is to become a better athlete & cricketer.

Changes to terms

Cricfit reserves the right to modify these Terms & Conditions at any time. Your continued use of the Services constitutes acceptance of the modified terms.

Governing law

These Terms & Conditions shall be governed by and construed in accordance with the laws of England & Wales.

Severance

If any provision or part-provision of this Agreement is or becomes invalid, illegal or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause shall not affect the validity and enforceability of the rest of this Agreement.

If any provision or part-provision of this Agreement is invalid, illegal or unenforceable, the parties shall negotiate in good faith to amend such provision so that, as amended, it is legal, valid and enforceable, and, to the greatest extent possible, achieves the intended commercial result of the original provision.
